Thank you for your interest in INTELLIGAINS®. Protecting your personal data is important to us. Below we explain which data we process, for what purposes and on what legal basis.

We have not appointed a data protection officer, as we are not legally required to do so. If you have any questions about data protection, please contact us directly using the details above.

2. Hosting and shop system (Shopify)

Our online shop runs on the Shopify platform. The provider for merchants in the EU is Shopify International Limited, 2nd Floor, 1-2 Victoria Buildings, Haddington Road, Dublin 4, D04 XN32, Ireland (“Shopify”). Shopify provides the servers, the shop software, the checkout and order management, and in doing so processes all data that you enter in our shop or that arises when you visit it.

When you visit our pages, access data is processed automatically (e.g. IP address, date and time, page visited, browser and operating system, referrer URL). This is necessary to provide the shop and to keep it stable and secure (Art. 6(1)(f) GDPR; legitimate interest in a secure, functioning online service).

Shopify acts as our processor (Art. 28 GDPR). Data may also be transferred to Shopify Inc. in Canada and to sub-processors in the USA. For Canada, there is an adequacy decision of the European Commission. Transfers to the USA are based on the EU-U.S. Data Privacy Framework where the recipient is certified, and otherwise on the European Commission’s standard contractual clauses. More information: Shopify Privacy Policy.

3. Orders and contract processing

When you place an order with us, we process the data you provide during checkout (e.g. name, address, email address, phone number if applicable, the content of your order and, for personalised items, the number you chose). Mandatory fields are marked. Without this information we cannot process your order. The legal basis is Art. 6(1)(b) GDPR (performance of a contract).

Once the contract has been fully performed, your data is restricted from further processing and deleted after the retention periods under tax and commercial law have expired (up to 10 years depending on the document, § 147 German Fiscal Code (AO), § 257 German Commercial Code (HGB)) (Art. 6(1)(c) GDPR), unless you have consented to further use.

4. Customer account

You can choose to create a customer account. We then store your data for future orders and show you your order history (Art. 6(1)(b) GDPR). You can have your customer account deleted at any time; a message to info@intelligains.shop is sufficient. Statutory retention obligations remain unaffected.

5. Contact and chat

If you contact us by email, contact form or via the chat on our website, we process your details to handle your enquiry (Art. 6(1)(b) GDPR for contract-related enquiries, otherwise Art. 6(1)(f) GDPR; legitimate interest in answering enquiries). For the chat we use Shopify Inbox, a Shopify service (see section 2). Once your enquiry has been dealt with, we delete it unless statutory retention obligations apply.

6. Payment processing

Depending on the payment method you choose, we pass the data required for payment to the respective payment service provider (Art. 6(1)(b) GDPR). Some payment service providers collect this data themselves. In that case, their privacy notices also apply.

  • Shopify Payments (credit and debit cards, Apple Pay, Google Pay and others): Shopify International Limited (see section 2) in cooperation with Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland.
  • PayPal: PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg. PayPal privacy notice
  • Klarna: Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden. Klarna may carry out an identity and credit check to verify the chosen payment method. Klarna privacy notice

To prevent fraud, payment and order data may be checked by the providers named above (Art. 6(1)(f) GDPR; legitimate interest in protection against payment default and fraud).

7. Shipping

For delivery, we pass your name and delivery address to DHL Paket GmbH, Sträßchensweg 10, 53113 Bonn, Germany (Art. 6(1)(b) GDPR). We only pass on your email address or phone number if you have consented to this during checkout so that DHL can notify you of the delivery (Art. 6(1)(a) GDPR). You can withdraw this consent at any time, either to us or to DHL. To create shipping labels, we use Shopify apps that connect to DHL.

8. Newsletter and email marketing

If you sign up for our newsletter, we use your email address to send you information about new products, promotions and events (Art. 6(1)(a) GDPR). Sign-up uses the double opt-in procedure: you receive an email with a confirmation link, and only after you confirm is your subscription active. We store the time of sign-up and confirmation as proof of your consent. After confirming, you receive a one-time discount code.

We send our newsletter via Shopify Messaging, a Shopify service (see section 2). We analyse whether a newsletter was opened and which links were clicked in order to improve our newsletters. This is part of your consent.

If you have started but not completed an order and have consented to email marketing, we will remind you of your cart by email.

You can unsubscribe at any time via the link at the end of every newsletter or by sending a message to info@intelligains.shop. This does not affect the lawfulness of processing carried out before you unsubscribed.

9. Product reviews (Judge.me)

We use the Judge.me app (provider: Judge.me Ltd.) for product reviews. If you submit a review, the name you provide, your review, any photos and the information whether you bought the product from us (“verified purchase”) are stored and published (Art. 6(1)(a) GDPR). We only send you an email asking for a review if you have consented to this. You can have your review deleted at any time.

10. Cookies and consent

We use cookies and similar technologies. We use technically necessary cookies (e.g. for the cart, checkout, language setting and saving your cookie choice) on the basis of § 25(2) No. 2 of the German Telecommunications Digital Services Data Protection Act (TDDDG) and Art. 6(1)(f) GDPR. We only use all other cookies and technologies for statistics and marketing with your consent (§ 25(1) TDDDG, Art. 6(1)(a) GDPR).

We obtain your consent via Shopify’s cookie banner. You can change or withdraw your choice at any time via the “Cookie settings” link in the footer of our website.

11. Statistics and marketing (only with your consent)

  • Shopify Analytics: analysis of how the shop is used (e.g. pages visited, cart actions) in order to improve our offering. Provider: Shopify (see section 2).
  • Meta Pixel and Conversions API (Facebook and Instagram): Meta Platforms Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland. We use them to measure the effectiveness of our ads and to show visitors to our shop relevant advertising on Facebook and Instagram. Usage data (e.g. products viewed, purchases) and, where applicable, hashed contact data are transmitted to Meta. We and Meta are joint controllers for the collection and transmission (Art. 26 GDPR). Transfers to the USA are based on the EU-U.S. Data Privacy Framework. Meta Privacy Policy
  • Google (Google & YouTube app, Google tag): Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Measurement of visits and purchases from Google Search, Google Shopping and YouTube, as well as measurement of advertising success. Transfers to the USA are based on the EU-U.S. Data Privacy Framework. Google Privacy Policy
  • TikTok Pixel: TikTok Technology Limited, 10 Earlsfort Terrace, Dublin, D02 T380, Ireland. Measurement of the effectiveness of content and ads on TikTok. Data may be transferred to countries outside the EU. This is based on the European Commission’s standard contractual clauses. TikTok Privacy Policy

You can withdraw your consent at any time with effect for the future via the “Cookie settings”.

12. Partner programme and discount codes of our athletes

We work with athletes who receive their own discount codes or partner links. If you use such a code or link, we record which partner the order is attributable to in order to settle the partnership (Art. 6(1)(f) GDPR; legitimate interest in settling our partner programme). For this we use Shopify Collabs and the UpPromote app. For partner links, a cookie may be set for this purpose. This only happens with your consent (§ 25(1) TDDDG). Partners do not receive any personal data about you, only information about referred orders and sales.

13. Other shop features

  • Product options (Globo Product Options): for selecting and personalising products (e.g. your chosen number on the tank). Your entries are stored with your order (Art. 6(1)(b) GDPR).
  • Announcement bar (Hextom Quick Announcement Bar): displays notices in the header of the page. To our knowledge, personal data is only processed to the extent technically necessary (e.g. IP address when loading) (Art. 6(1)(f) GDPR).

14. Our social media profiles

We have our own profiles on Instagram, Facebook, TikTok and YouTube. On our website, these are only included as simple links. Only when you click a link are you forwarded to the respective network, and only then is data transmitted to its provider.

When you visit our profiles, the operators process your data in accordance with their own privacy policies. We and Meta are joint controllers for the statistics of our Facebook and Instagram profiles (“Insights”) (Art. 26 GDPR). Meta provides the corresponding agreement. You can send requests regarding your rights directly to the respective operator or to us.

15. Your rights

You have the right to

  • access the data we process about you (Art. 15 GDPR),
  • rectification of inaccurate data (Art. 16 GDPR),
  • erasure (Art. 17 GDPR) and restriction of processing (Art. 18 GDPR),
  • data portability (Art. 20 GDPR),
  • withdraw any consent you have given with effect for the future (Art. 7(3) GDPR),
  • lodge a complaint with a data protection supervisory authority (Art. 77 GDPR). The authority responsible for us is the State Commissioner for Data Protection and Freedom of Information of North Rhine-Westphalia (Landesbeauftragte für Datenschutz und Informationsfreiheit Nordrhein-Westfalen), Kavalleriestraße 2–4, 40213 Düsseldorf, Germany.

Right to object (Art. 21 GDPR): Where we process data on the basis of legitimate interests (Art. 6(1)(f) GDPR), you may object to the processing at any time on grounds relating to your particular situation. You may object to processing for direct marketing purposes at any time without giving reasons.

To exercise your rights, a message to info@intelligains.shop is sufficient.

16. Data security and updates

Our website is encrypted throughout using SSL/TLS. We will update this privacy policy if our data processing or the legal situation changes.

Last updated: October 2026. In case of any discrepancy, the German version prevails.
